1. Preliminary Provisions
These terms and conditions apply to purchases from the online store www.mateuszpiesiak.pl. The terms and conditions strictly outline and define the rights and obligations of the seller, Mateusz Piesiak Art, 14/9 Łódzka Street, postal code: 50-521 Wrocław, NIP 8992962656 (hereinafter also “Operator”), and the buyer (hereinafter also “Customer”).
2. Order and Purchase Agreement
All orders placed through the online store www.mateuszpiesiak.pl are binding. By placing an order, the Purchaser confirms that he/she is familiar with the terms and conditions of sale, including the terms and conditions of purchase, as well as the purchase procedures, and fully agrees with them. All prices listed on www.mateuszpiesiak.pl include VAT.
The order from the customer is a document of the purchase contract. The purchase contract comes into force at the moment of receipt of the goods by the buyer.
The online store www.mateuszpiesiak.pl has all the necessary information necessary to conclude a contract in the general sense, as well as significant details of the purchase contract, as defined in the Civil Code. The contract will always include the name of the product, the features of the product and its price.
As a condition for the validity of an electronic order, all necessary data and information specified in the order form must be provided.
The place of delivery is the address specified by the Buyer in the registration form. The delivery price shown in the form applies to shipments within Poland. The price of foreign shipments determined individually. The Buyer should inform the Seller before the purchase about the need for shipment abroad by e-mail in order to determine shipping costs.
Ownership of the goods passes to the Buyer at the time of receipt of the goods by the Purchaser, provided that the goods have been paid for.
By completing the registration or binding order form on the online store www.mateuszpiesiak.pl, the Buyer gives the Seller permission to collect and archive all personal data concerning the Purchaser’s purchases.
3. Disclaimers
All claims will be processed in accordance with the Civil Code in Poland.
4. Rights and Obligations of the Seller
The Seller must complete all binding orders, ship the ordered goods and deliver them to the Purchaser at the address within the time specified by the Seller on the order confirmation. The Purchaser will receive a bill/invoice on the goods received.
All information obtained during the registration process is confidential in accordance with the applicable Personal Data Protection.
The Seller is obliged to remove the registered Customer from the database, if requested by the Customer in writing.
The Seller has the right to refuse to accept an order if the ordering party has not fulfilled the obligation to take possession of the goods or to pay the purchase price.
The Seller has the right to withdraw from the purchase contract (binding order) in case the implementation of the order is impossible, unless a new implementation is agreed with the orderer. In the case of advance payment (by bank transfer) for the goods by the purchaser, and his / her withdrawal from the contract for the reason described above, the Seller will return to the purchaser the entire amount paid no later than 15 (fifteen) days after the delivery of written notice of withdrawal from the contract.
5. Rights and Obligations of the Buyer
The buyer must provide a correct and complete postal address to which the goods are to be delivered.
The purchaser must accept the ordered goods and pay the full price. The full price is shown to the customer during the processing of the order and before its binding confirmation.
The buyer has the right to remove all his personal data from the database, if he requests it in writing. The Seller undertakes to remove all of the Orderer’s data from the database, no later than 3 (three) days after the delivery of such a request.
The Purchaser has the right to withdraw from the contract within 14 (fourteen) days from the date of receipt of the goods. Withdrawal from the contract must be delivered by registered letter sent by the Purchaser to Mateusz Piesiak Art, 14/9 Łódzka Street, postal code: 50-521 Wrocław. The letter must contain the Purchaser’s identification; the goods to which the withdrawal applies; the account to which the amount of the product’s value will be transferred; the letter must be hand-signed and delivered to the Seller within the aforementioned 14-day period along with the goods. The goods must be in an undamaged condition, with no signs of use or wear, in the original packaging, intact. Shipping costs are paid by the customer. When the preceding conditions are met, the Seller will return the purchase price to the Customer in the form of a bank transfer.
6. Complaints
The Ordering Party has the right to submit complaints to the email address [email protected]. Complaints shall be considered within 14 calendar days from the date of receipt of the e-mail.
7. Final Provisions
These terms and conditions apply as stated, which is posted on the Seller’s website, on the day the Purchaser places an electronic order.
By placing an electronic order, the Purchaser accepts all provisions of the terms and conditions of sale as in effect on the date of placing the order, as well as the applicable price of the ordered goods indicated in the catalog of the online store www.mateuszpiesiak.pl, except if otherwise agreed. Prices of goods listed in the catalog of the online store www.mateuszpiesiak.pl are valid only until the prices are modified; orders sent after the modification of prices are subject to the new price.
These terms and conditions become effective on July 26, 2022.
